>> your realtime captioner is mrs. linda m. macdonald north korea has released a video of a palo alto man admitting to war crimes six decades ago but not everyone is buying it and now the white house is getting involved in the push for his release. good afternoon, i'm frank mallicoat. michelle is on assignment. 85-year-old merrill newman has be detained in north korea now for more than a month.

kpix 5's mark kelly is in our newsroom. we're learning that newman apparently in good health. mark. >> reporter: frank, swedish diplomats have been able to visit him giving him medication for his heart. the obama administration is now urging for newman's release citing his advanced age and health conditions. >> i can understand that in u.s. and western countries, there is misleading information and propaganda about pprk. >> reporter: north korean state media released this video over the weekend of detained american tourist 85-year-old merrill newman reading a handwritten apology. pyongyang said newman admits he is guilty of big crimes when he fought for the u.s. in the korean war killing civilians, working with anticommunist guerrillas and planning now 60 years later to try to meet up with them. the video shows newman signing the four-page statement he read on camera dated november 9 and

sealing it with his thumbprint in red ink. what was to him next isn't clear. after being held since late october, taken off a plane just as his tour group was leaving, the white house is now weighing in. a spokesman saying, the u.s. is deeply concerned, calling on north korea to release newman and fellow american kenneth bae, now held for more than a year. but one expert says that could complicate and already sensitive situation. >> north korea doesn't want to give impression to the world that north korea is giving in to the demand of pressures coming from washington. >> reporter: former u.n. ambassador bill richardson, who says his north korean contacts aren't responding, told cnn on sunday that kim jong-un isn't following north korea's usual pattern of releasing americans after getting a purported confession. >> so this is baffling opposite but this is a new regime of the

new leader and i suspect he is sending different signals but nobody knows what those signals are. >> reporter: newman's family expressed appreciation for north korea's cooperation. they released a statement saying merrill is in good health and reports that he is being well treated and the food is good. >> thank you, mark kelly live in the newsroom. lots of people are headed out on black friday last weekend but they didn't spend as much as they did last year. that's according to the national retail federation. 141million people went shopping over the holiday weekend, up by 2 million from last year. total spending is expected to top out at $57 billion but that's actually down nearly 3% from last year. today though is the biggest day of the year for retailers online. sales on the internet are expected to break a record and kiet do has more on what consumers should look out for. >> reporter: on this cyber monday, sure, there are good deals but how do you know they're great deals?

online databases like savings.com and pricegrabber.com claim to do all the heavy lifting by pulling coupons and deals from multiple online retailers. >> take advantage of deal sites as well as online databases that congregate or help collect all that information in one place. so it really takes the hard work out of it for you. >> reporter: cyber monday has now grown into a cyber tuesday, wednesday and so on. it's more like a cyber week that's now worth about $1 billion. a mommy shopping blogger says she has noticed another trend that hits about mid-december. >> around december 15, a lot of discounts on jewelry, handbags, other apparel items, and they are trying to clear their extra inventory and know that us, as consumers, are looking to go out and buy all these holiday gifts. >> reporter: that coincides with annual free shipping day and that takes place on december 18. in san jose, kiet do, kpix 5. >> today is the busiest shipping day of the year for fedex and it could be the

company's busiest ever moving some 22 million boxes in a single day. online shopping is fueling the growth. cyber sales are projected to top out at $1.8 billion. and someone has to shop all those purchases. fedex has a 300,000-person staff around the world for deliveries and adding seasonal workers to help. we'll see some cold weather here in the bay area the first week of december. let's go to lawrence and find out how cold it will go. >> this easily is the coldest outbreak of the season headed our way right now. still got a little ways to get here. that cold front working its way down from the gulf of alaska. that is going to usher in some much colder air starting tonight. it will begin to move into our skies. there's even a chance of some cold showers overnight but it's going to be those cold temperatures that you're going to be talking about all week long. in fact, this is what we can expect. a few cold showers tonight. tomorrow temperatures dropping 8 to 12 degrees from today's highs and then some freezing temperatures especially into wednesday and thursday morning,

we could see a hard freeze with some of those temperatures down into the 20s and the low 30s. we'll have more on your weather coming up in just a minute. back to you. >> thank you. right now san francisco police are trying to find a killer who was connected with the victim online. the fought tal shooting happened yesterday -- fatal shooting happened yesterday afternoon at bayshore boulevard and jerrold avenue in the bayview. he was robbed and shot several times when he showed up when he was to meet the buyer. san mateo police say a man hit and killed by two cars was not in a marked crosswalk at the time. he 58-year-old was hit around 6:15 this morning on el camino real under highway 92. investigators are trying to figure out if he came from a nearby homeless encampment. traffic tied up for several hours while police were investigating the accident. one car involved left the scene but police have found it and say both drivers are cooperating. a toddler who was trapped under water for more than 10

minutes is making a miraculous recovery. brian webb talked to the rescuers credited with saving the young boy's life. >> reporter: it was a typical saturday afternoon at vallejo fire station 23 when a 911 call came in from one district over. but when a little boy is drowning, you don't worry about the address. >> i actually was working out in the gym so i was in a t- shirt and shorts. >> reporter: a 2-year-old had fallen in this murky green pond while fishing with his grandmother. she couldn't find him after searching for nearly 10 minutes. when diane arrived, she jumped in and spotted the boy in a drain pipe on her second dive. >> he actually had drifted underneath the road and was suspended. so i saw him, saw the white t- shirt, grabbed him and i was able to stand on the bottom, raise my hands up and i handed him off. >> like an overpass. >> reporter: apprentice firefighter wally trajillo six months on the job started chest compressions and prayers. >> every firefighter, par middic would have to agree when it's a pediatric, it's an eerie feeling because you never know

the outcome. >> reporter: the water here is five feet deep and very cold. that along with the fact this boy is very young probably saved his life. >> incredibly cold, which that gives the child a way better chance of having the least amount of deficits or making a full recovery. >> reporter: 24 hours later, word reached the crew, the boy was doing better, so much that he is expected to make a full recover. >> wow! it is the best early christmas present that all of us could imagine. >> reporter: just another day on the job at fire station 23, saving lives along the way. brian webb, kpix 5. >> that toddler's grandmother dove in after him. she was also taken to the hospital, treated for hypothermia. she is expected to make a full recovery, as well. bart's two biggest unions are working on a lawsuit against the transit agency over their contract dispute. "the examiner" reports a union official expects a suit could be filed this week. the issue is that tentative contract that union members are

proved back in october. bart's directors removed a family leave provision before they voted to ratify that deal. today there's a new 600- foot-long barricade at the [ indiscernible ] to halt a dangerous stunt by commuters just off highway 121 near the intersection with 37. that's where the traffic often backs up in the afternoon and some people trying to get to vallejo turn left on to 121 and make a u-turn into the raceway's driveway and head back to 37. this has already caused a crash and a number of near misses, as well. some other news around the bay on this monday two earthquakes shook gilroy overnight the first 2.5, at 1:30 this morning then 2:05 a 3.7. both centered about four miles south-southeast of gilroy. we have had no reports of damage or injuries. santa rosa teen shot and killed by a sheriff's deputy may have a memorial park created in his honor. sonoma county lawmakers will meet tomorrow to discuss the request from the community, a

deputy shot 13-year-old andy lopez in october because he mistook the teen's bb gun for an assault rifle. new details about the google barge at treasure island. according to a confidential budget report from the bitter it's the first of three that google plans to launch. they will be docked here in san francisco, one in l.a. and one back in new york. the barges are intended to be floating retail stores. no confirmation in google. the company will only say the current plan is to use the barges as an interactive space where people can learn about new technology. coming up, federal authorities are now looking into the train derailment that killed four people over the weekend in new york and today we're hearing from passengers about that terrifying experience. and as fans mourn the death of actor paul walker, police zero in on the cause of the crash. ,, ,,,,,,,,,,,,,,

passengers on the new york commuter train that jumped e federal investigators are interviewing the crew and the passengers on that new york commuter train that jumped the tracks killing four people. reporter marlie hall explains speed may have been a factor. >> reporter: workers used cranes to upright train cars that toppled during the deadly crash. investigators from the national transportation safety board are looking for clues that might explain what caused the commuter train to jump the tracks. they are also analyzing the train's data recorders to determine if the engineer may have been going too fast as he rounded a bend. >> a curve like this has a speed limit and the speed limit was 30 miles an hour. at that speed, there should be no problem navigating the curve. >> reporter: the train's engineer william rockefeller, jr., has not yet spoken to investigators. a law enforcement source told cbs news, rockefeller informed

first responders the brakes were not working properly. until the tracks are cleared and repaired, about 26,000 commuters are using shuttle buses and subways to get to work. 58-year-old james lovell is one of four passengers who lost his life sunday. the audio technician was heading to manhattan to prepare for th lighting of the rockefeller center christmas tree. several others were injured including this man who was treated and released from the hospital. >> there was a lot of smoke, dirt and gravel. i looked down and realized that my hand and arm was all blood. and then you have to start saying to yourself, whose blood is it? >> reporter: ntsb investigators say it could take up to a year to determine the cause of the crash. marlie hall for cbs news, the bronx, new york. >> officials say this accident could have been a lot worse if it happened on a weekday during the commute. the metro-north train was only about half full yesterday. speed is a focus of the investigation into the crash

that killed "fast & furious" actor paul walker and friend in southern california. grieving fans created a memorial at the scene of saturday's crash in valencia. 40-year-old paul walker was a passenger in his friend's porsche when it hit a pole. the 7th film of the series is going to be released next summer. and some troubleshooters for the federal healthcare website say it can now handle 50,000 users at the same time. the department of health and human services says system failures have fallen significantly and response times for web pages are less than a second. these are become critical issues for democrats. public perception of the website could be a factor in next year's midterms elections. the big board on this monday, stocks are down following some weak black friday sales on friday. but right now, down about 44 points. and holding steady not even the 12 days of christmas are immune to

inflation. buying all the gifts mentioned in the classic christmas carol would cost you more than $27,000 this year up almost 8% from last year. if you buy all 364 items repeated throughout the 12 days of christmas, usual going to pay almost $115,000. the most expensive gift, the 7 swans a-swimming, which will cost you about $1,000 each. >> what about the five gol rings? >> forget the birds. give me the gold any day. we are going to get really cold. this is the coldest outbreak of the season so far. it looks like a cold front is diving into the bay area now that will bring with it major changes in the forecast. today outside not bad at all. this is probably the last day that we are going to see temperatures in the 60s for quite some time. in fact, a couple of high clouds drifting overhead. otherwise the numbers warming up nicely 62 degrees in concord now. it is 60 in san francisco and 58 degrees in san jose. as we sail through the afternoon, we'll see a mix of sun and clouds and mild

temperatures. and then this evening the clouds start to move in. there's a chance we could see a few showers overnight tonight into tomorrow. and then some very cold brisk weather ahead as a whole arctic air mass settles in over the bay area and it's up here now. this cold front will dive in overnight tonight into tomorrow morning. that will usher in the much colder temperatures outside. numbers around the state today, you will see some showers in far northern california about 53 degrees in eureka, 62 in redding and 65 degrees in sacramento. 57 mostly sunny into the monterey bay. computer models showing you the clouds starting to move in throughout the evening hours. and a chance of a few scattered showers overnight tonight. you see the clouds off and on throughout the day tomorrow, as well. and then once those clouds move out, it looks like tomorrow night and then into wednesday morning and thursday morning those will be the two coldest mornings, maybe we are seeing a hard freeze especially in some of the north bay valleys. temperatures around the bay area today looking at a lot of numbers moving up into the 60s this afternoon, 65 in milpitas,
